3. Description of Services

Delvechio Designs offers the following services under separate written agreement:

• Digital Marketing (SEO, PPC, Email Campaigns, Social Media)
• Motion Graphics & Videography
• Strategy Consulting

4. User Responsibilities

As a User, you agree to:

• Provide accurate, current, and complete information.
• Use our website and services in compliance with all applicable laws.
• Refrain from any activity that interferes with or disrupts our services.

5. Account Registration & Security

If our services require account creation, you are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

6. Fees, Billing & Payment

1. Fees will be agreed in writing before work begins.
2. Invoices are due within 30 days of receipt, unless otherwise stated.
3. Late payments may incur interest up to 1.5% per month or the maximum permitted by law.
4. We may suspend services for unpaid balances.

7. Cancellation & Refunds

Either party may terminate a service agreement per its terms. All work completed up to termination will be billed in full. Refunds are issued at our discretion and according to the specific service contract.

8. Intellectual Property

We retain ownership of all materials, designs, code, and content until payment is received in full, at which point rights transfer as specified in your agreement. We may display your project in our portfolio unless you request otherwise in writing.

9. Confidentiality

Both parties agree to keep all non-public information received from the other confidential, including proprietary processes and pricing.

10. Disclaimer of Warranties

Our website and services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose.

11. Limitation of Liability

To the fullest extent permitted by law, Delvechio Designs will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of our services or site.

12. Indemnification

You agree to indemnify and hold harmless Delvechio Designs and its affiliates from any claims, liabilities, damages, losses, or expenses arising from your breach of these Terms or misuse of our services.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Washington State, USA. Any dispute will be resolved exclusively in the state or federal courts in Spokane County, Washington.

14. Termination

We may terminate or suspend your access to our site and services at any time for conduct we believe violates these Terms or is harmful to others.

15. Severability

If any provision of these Terms is held invalid, the remainder will continue in full force.

16. Entire Agreement

These Terms, together with any written service agreement, constitute the entire agreement between you and Delvechio Designs.
